Softmod Illegal?
« on: July 19, 2005, 06:33:00 AM »

It depends on your country. In many countries it is forbidden to sell software/hardware that circumvents the copy protection. Therefore softmods/chips are illegal to sell in these countries.

on a side note: 25.000 euros seem to be a little bit "overpriced" for only selling softmods. You didn't sell any games with it, did you? Or were you selling these softmods on a great scale (say, ebay for example)? And did these softmods use PBL loader or nkpatcher?

From looking at your username, I guess you're Dutch.

In that case : softmodding is 100% illegal.

Here's why :

* Software used to mod was built with stolen MS software.
* Even if you used the 'cromwell bios' somehow, it's still illegal as it's a way of avoiding copy protection.

Just to illustrate (in Dutch) : http://www.webwereld.nl/articles/36139

It's not the 'Brein' part that should worry you, it's the 'artikel 32a van de auteurswet' ....

So ... if you got busted on that article, there's very little you can do, except hire a lawyer.

Just curious.

again, am I the only one that is noticing the ridiculous high fine here? I mean, seriously, 25.000 just for installing softmods is a very high fine if you ask me. Either he was doing this on a great scale (ebay, whatever), or he was doing something related to piracy (unintentional.maybe SCEEE?) Well, actualy if he used PBL with a hacked bios that would be it. But then again, there has to be some great scale involved to justifiy the high fine.

I'm curious,

How many xboxs did you softmod? Were they friends or customers? Did you charge and if so how much?

Did you sell them with any games or anything?

And how did you get caught?

My guess is they caught him on several 'occacsions' (Dutch : gebeurtenissen).

Clueless what th e fine is per 'occasion', but if it's modding, let's say, a 100 xbox's .....

If it's modding and copying games (which isn't that unusual in the Netherlands ....) It could be a multitude of that ammount.

Did you softmod xboxs then murder the owner with their xbox or something?

25.000 is crazy.

6 boxes, caught by phone, and you know the fine. Has this actually been to court or have you actually been officially notified of prosecution and fine etc. Somethings not quite right here. The amount you have suggested is  not the sort of fixed penalty the police would just issue a ticket for.
