The main problem people were having is they replaced the MS dashboard with evolution X (by renaming the MS dash) and then Live tried to update the MS dash (which was really the Evo X dash) and nuked their box (which is recoverable anyways with an EvoX CD).   As long as you use a BIOS that loads the EvoX dash from a different filename you'll be fine.  You can use duped games running from the harddrive on Live.  At least right now you can.   I'm not going to trust that MS will do nothing though.  I'm buying my Live games and running in Mode 3 with the mod disabled when I'm on Live.
