Evo-x Only Boots When Dvd Drive Is Open?

For some reason or another the only way my xbox can boot to Evo-X using the Original Ernie and Bert is when the DVD Drive is open.  Is anyone else having this problem or know if it can be fixed.

when you boot with it closed, is there a game in the drive?
