Haven't Been On Live For 2 Months Now....

I'm in the process of moving and my modded xbox has been in storage.  Well, i'm getting ready to move in my new place and the first thing I want is to fire up Live.  I have it modded and the last time I've used it was 2 months ago.  

Here's a scenario:
Will I get banned if I play let's say... PGM2 on Live?  Or with the new MS technology of banning people will they wack my account?  If I get banned, can I put in my old original hard drive and play on Live again or will I have to flash my EEPROM first, then put in the original hard drive?
