Well, if it helps.... OXM (Official Xbox Magazine) basically stated (I assume as M$' official mouthpiece) that modding would not incur their wrath, except when used with Xbox Live. In essence, they gave it an implicit OK.

For the record, it might be mentioned that the PSX, a product Sony still sells to this day, profitable enough after 8 years to still publish major releases for, is also one of the most modded systems ever. This isn't to say modding won't undercut a company's profits, but it also doesn't guarantee it's demise.

BTW: Have you seen those FABULOUS homebrew apps, Media X Menu or X-Marbles?

I think the mysterious poster behind R-M has already uploaded a picture of himself in the past, so that would most likely not making him Kevin Rose.
