You can either update to LT 3.0 or go back to stock. If you don't care about backups anymore then return to stock.

Regarding being banned, the console could already be flagged and could result in a ban. Only for sure way is to go back online. The only thing you will lose is Xbox Live and I believe you will no longer be able to take your game saves onto another Xbox.
