To play the retail game offline you need Xbox Live installed but there is a Evo-X release that will work offline without a gamertag.

UPDATE: Do not delete the patch and then sign on and re-download it. The server records how many time you download it and will ban you.

um this is NOT true i make a lv 200 guy with 5min and went online and they did not do anything.

You can't do anything with Action Replay to get you banned.

LOL thats what you get for cheating.. but if you really worry about sega counting how many times you download the XBE in tdata then why not back it up and restore it after your done?
