If you managed to connect to XBL with the softmod enabled, you'd be banned instantly for running a non-retail kernel.  Sounds like you were lucky and your softmod blocks XBL connections.

No.  To play a backup on XBL, you have to alter the kernel to allow execution of unsigned code.  Therefore you are running a non-retail kernel.

Apparently all the info is out there if you want to go looking and do it all yourself, but you'd have to know exactly what you're doing.
