how old is your tv? it sounds like its on its way out?

It's a five year old 52 projo TV. Picture is sharp and looks perfect with my Sony DVD player so it's not the tv...
Since posting this I took 2 screenshots; One while setting the top-left corner and the other at the bootm-right corner. On my TV none of the black was visible so that's the viewable area I'm losing even outside of XBMC:

I'd say you just have to adjust the overscan on the TV. The amount of overscan usually depends on the connection used and the connected device. That is why you don't notice it with your DVD player.
Depending on your TV's brand, it should have a service menu you can enter to adjust the overscan levels. If you don't know how to do this, get a technician to do it for you.

I have the same problem but i have two xboxes on one its tilted to the right a little and on the other its tilted to the left a lot are there not any other thing you can do but to open the tv?

Step 1. Go out and buy the AVIA guide to home theatre dvd disk or DVE
Step 2. Goto the http://www.avsforum.com and find out the service menu codes for your set to adjust overscan
Step 3. Use the test pattern from Avia to adjust the overscan on your set.
This won't make it 100% perfect. My set is set at about 5% overscan and I still have issues with the dashboards getting cut off. But in game, everything is perfect for me.
