If you're using a modded xbox 360 on live to play backups,the only thing that gets banned is your 360 not your account or gammer card.

So, no trails left on that memory card then? And any idea if those Microsoft updates can save to a MC? I'm guessing no because then you'd have to transfer to the cache folder somehow.

you'l be fine they wont ban an unmodded console just because you used the same hardrive in it as you used in a modded and banned one.

Think how crazy it would be if they did? people lending friends hardrives, buying second hand ones etc.. and remember MS dont even make profit off selling a console.. only on the games do they make profit so it wouldnt make sense for them to ban an unmodded console of someone who just bought one because they're old one was banned -

think about why when some-ones console is banned their live account isnt? they dont want to loose you as a customer they just want you to play by the rules
