Title: Hypothetical Question

Lets say the xbox360 does get modded/hacked/chipped. And once you mod it you can not take it online any more, or you get banned. Will M$ legally have the right to deny you the ability to play the same account to tryed to use on your modded xbox360 on XBL on your unmodded/hacked xbox360? I know that this wasn't the case for the Xbox, but I have the feeling this will happen for the XBox360 and and being always connected.

Xbox Live is their system.

They can do what ever they want, this includes permabanning your gamer tag.

Before gaining access to live you must agree to the Terms of Agreement.  All of the details on their banning process are in there.

MS has enough lawyers to make sure everything they say and do is perfectly legal.

If you are banned on the xbox it bans your xbox's eeprom so you can either buy a new xbox or use another eeprom which is illegal.

As bluvasa MS owns the system and they can do whatever they want with your account.

Theoretically they could legally ban your account on XBL today... for modding or for whatever reason.

Go read the contract you agreed to when you signed up. They reserve the right to deny you service for any reason they seem fit.

It's perfectly legal because they designed the system, they designed the rules of the system, and YOU agreed to the rules.

We're all just really lucky that MS decided to only ban the modded console and not the accounts trying to go on XBL.

If I had to guess I'd say MS will carry the same tradition with it into the Xbox360
