The update is on the game itself. I haven't heard of a problem with this update and modded consoles.

Tell your friend to update his console. He does not need to go on Live to do it.

as others have said, the update is on the disc. he can pull the ethernet cable and install the update. on a side note, if you won't touch live out of fear of a ban, how is that different from actually being banned in terms of xbl's usefulness?

right now it IS safe to go online with a modified firmware and a retail disc. it WON'T get better then that because MS will always be improving their detection methods. there is a better chance of being able to get yourself unbanned in the future like on xbox1 then there is of finding a way to guarantee never becoming banned.
