My 360 started giving me the "3 lights of doom" so I called MS and got a 1 year extened warranty. I didn't know that this could not be done outside the 90-day warranty (honestly). Anyway, the guy at MS gave me the 1-year warranty with no questions asked. I gave him my credit card info and said it would take about a day or so to take effect. I even have the order number for this transaction.
I called MS today and I guess they noticed the mistake. I finally spoke with some supervisor who said that they could not do that, and that I would not be charged for the 1-year warranty since they could not offer it outside the 90-day period, and they would not honor it, and I would have to pay the full $129 to have my 360 repaired. However, he kept asking for the last 4-digits of my credit card to process the refund. I told him that he would only need to do that if the transaction had already been completed and I was charged, blah blah blah...
Anyway, the conversation ended by me telling him that I severlely questioned the legality of his actions and that I was not going to authorize the refund by giving him the last 4-digits of my credit card until I spoke with my lawyer. I plan on running it by him on Monday, but I thought I would check with you guys to see if you have ever heard of anything like this. Can they sell you a warranty and then not uphold it?

Either way, I'd say you're in the wrong. They made a mistake. Documentation says that you have to apply within 90 days. You did not, therefore the transaction you made should be null. It shouldn't matter that they were going to give you the warranty since you yourself did not comply by the rules set forth in the warranty. It was over 90 days.
After you are done arguing this (feel free to take it as far as you want, I just don't think you'll get far for a LOT of energy), maybe try replacing the Thermal Interface Material with some Arctic Silver 5, it might fix up your problem and save you a lot of hassles.
