I was just wondering which dashboard update was the one that actually has the been forwarding the information to M$ that lets them know you are running ixtreme firmware. Wasn't sure as I've been searching google and this forums for the past week. I was guessing it was the 8955 which was the wireless update I thought. I updated my xbox on nov.2 and have only been back online with it since then but wasn't sure if I was doomed to be banned if I flashed back to OFW at this point.
They are not actually able (from what c4eva has said) to see if you have the firmware on your drive unless you are playing a burned game. I have ixtreme 1.6 on my BenQ and am not banned because I have not been playing burned games online. I have, however been playing legit games online and it's fine.

Thanks for the answer so then it was to do with the dashboards 8955. Is there not on issue that if you play offline and get back online that you will get banned? I thought the NAND logged the games and info of the games you play and sends it when you the information to M$ once you log on again.
