Why should you have to disconnect from Live when you use this disc ?

Just because you're playing it doesn't necassarily mean that you're doing anything illegal. MS will not ban you for using it.

On the Xbox, MS ban users from Live who attempt to connect using a hacked bios as that usually means that they are running an illegal copy of the said game and also leaves other Live players open to possible hacks from that individual.

With this, there is no way of proving that you are doing anything unlawful, so therefore MS could be pursued with legal action if they banned users for having the kiosk demo image in their gamertag profile.
