Take my comments with a grain of salt.
I'm not sure if the 360 Dev kit is referred to as XDK(Xbox 1 Dev Kit).
As far as my understanding goes, the XDK is/was never meant to be released to the public.
The XNA is the best thing we have so far but will require about $99usd per year to get running on your Xbox 360, but the XNA does have it's limitations and it's legal.
Here's my speculation:
The way I see it is if we developed something with XDK, the only chance of it running would be through the 360's BC given the day the 360 is hacked. But then again the 360's BC will have to be hacked and need an "updated definition" to support/translate the newly designed software which will be too complicated. It's not as simple as a "redirect" to execute a certain file.
That's why not all Xbox 1 games are BC on the 360 as they are either too complicated or not worth it.
