Title: To Get..or Not To Get Banned..

I really dont care about playing online...but i would love to download some themes, and gamer pics. Do I run a risk of getting my 360 banned? Or do I actually have to run a backed up disc and play against somebody online? I was just wondering if u can get banned out of the blue for just being logged into the marketplace. thanks!
