is it possible for me to use a new hd, and use config magic to update eeprom and still be able to play on xbox live? or would that get me banned?

Yes, that's the way.
Just remember, the hard drive and the eeprom have to be xbox live virgins. And if the hard drive isn't going to be an xbox stock stock hard drive, you'll need to create a new XBOX Live! account.
