vader i didnt think that you could use a hdd with different eeproms, i thought that they were married together, and useless without the other. just wondering.

Couldn't he also use a larger hdd but just get a new gamertag?

I had the exact same situation about a month ago. I modded a 1.6 with a Xenium SP ICE for a friend along with a hdd upgrade and 1.6 eeprom upgrade. Slayer's installed everything Everything was peachy keen. This kat and I are good friends and he does a lot of his own modding and I am 99.99% sure he never signed on with the chip enabled and even if he had he would have told me. He was banned within 24 hours. I honestly think they have added some anti-piracy mechanism on the 1.6s and the 1.6s only. Me and this kat have modded several boxes and the 1.6s are the only onez that have ended up getting banned.

ive done several 1.6s with and they are all use don Live with no bannings, its probably that .001% chance he signed on with his chip enabled

did he have any hacked gamesaves on his xbox, or any exploits, because if they catch them they ban you for those too.
on a side note I have a 1.6 and have never had any problems with banning.

well if everything was as you said it, then he wouldnt be banned. The xenium chip is 99.999999% off when you boot to the stock bios not even m$ can catch that. The only thing that stays on is the led and thats just to keep noobs from logging onto live with the hacked bios. Is it possible that his gamertag was flagged from cussing or cheating, because that can get you gt flagged as well, The only difference is that you dont know about it. So when he logged in and they scanned him they saw the large hdd and BAN on his first log in.

no i have avalaunch on my c dirive and havent been banned, they only scan if the gamertag is flagged so usually they detect the big hdd b4 they even care about whats on the c, Was the gamer tag flagged for cheating or swearing because live is getting really touchy on that crap now.
