It appears some non-stock stuff can get you banned, such as font-exploits and softmods, but other than those you should be fine.

Possible, but no proof has been put forwarded as far as I know

I'm new to this forum, but I was just thinking, people are worried about getting banned, then they would need to get a un banned EEPROM to go on live again so why not just to play it safe and find a EEPROM That is already banned from live and use that for offline or for Xlink, Because I have a little brother that's bound to get me banned off of live. So have the Banned on the Mod setup and have original for stock or mod "off". This would make people feel safer knowing that they won't screw up their un banned EEPROM.

Well, you can do it failry easily by embedding the eeprom in the bios. Older X2 bioses could do this.

well you could certainly use atapwd to set a master password to match your banned "offline" eeprom

Don't know if it has been mentioned, but I'd delete the french gamesave...
