"Fake Gamertag" is the gamertag that allows you play PSO without a Xbox Live account. So, you obviously did download the game and that is what it means.
Other than that, I don't understand your last question...

was that sentence?I think you think you can play xbox live games somehow...er...no you cant.
if xbox live is not available yet, then its not available. that gamertag is only to let you play that one game that REQUIRES xbox live.

You can't play online with the "Fake Gamertag" PSO copy. Its a backup thats available at the usual places, and since you can't play backups on Live, you won't get banned at all.
