Let me clarify this....
The BFM is a modified BIOS, even if it's retail. The hash won't match, right? If Live detects the BIOS loaded in RAM, it will likely fail the hash check.
If the BIOS on the mod is retail, but the BIOS in RAM is not, as in the case of exploiters, Live obviously detects this... Exploiters get banned from Live all the time. So obviously, this doesn't work. This is similar to the "stealth" mode attempts in the past, actually, switching out the mod.
If the BIOS on the mod is hacked, but the BIOS in memory is "retail" - it's a BFM BIOS, and as I said earlier, the hash is different.
I don't know all of the mechanics of the Live check, but simple observation and logic have demonstrated that M$ is detecting anything but an unhacked, non-BFM BIOS for Live, and any active modchip attached to the system.

007/Mechassault loaders = BAN
Modchip = BAN
Modchip with disable switch = BAN
TSOP flash = BAN
TSOP flash with bank selection = BAN
Any other hack-methods that I've forgotten or don't know about = BAN

Ummm , no ... actually you can use LIVE with a modchip that has a disable switch as long as the mod is actually disabled and you use original retail games .---DGP---

NO, that doesn't sum it up. That's false information.
A modchip with the retail BIOS won't result in a ban.
A modchip with a disable switch that is disabled wont result in a ban.
A TSOP flash with bank selection, I don't believe will result in a ban.
You can use XBox Live with all sorts of configurations, as long as the retial bios was booted when you go on live!

for personal experience i can tell you that the answer above describe best how you can use xbox live! I have 2 xbox one with a 29wire *enigmah chip* and one with x2 pro chip....both of them are 101% working on xbox live as long as i turn the chips off by switching them off!
