You won't be able to connect at all if you're already banned. The LIVE servers will refuse the connection.

If your console was marked for a ban 8 months ago, it's already been banned. Your console might not be aware of that fact, but the LIVE servers won't accept its connection. It'll fail with an error message detailing the ban.

If you've been flagged, you're already banned. The second you try to connect to LIVE it will fail and you won't be able to sign in. You'll get the standard "You've been banned" message.

You won't know for sure until you connect. But it's not likely you'll be able to update anything as, by your own account, you're probably already banned.
