LEAGAL BIOS how can we code one orselves?

mostly the problem with homebrew apps is that they are making their software with a illigal SDK (Software Developer Kit)

so is if the sdk is the only problem then. has anyone tried to turn the sdk into a legal set of tools. cause it seems this xbox scene is only interested in playing backup games than creating new games/apps etc..
