Depending upon whaty dashboard you are using, it will look for a default.xbe file in the root of your dvd and start executing that when you insert a disk. Some dashboards have an option to turn that auto play feature off. In that case you can launch the default.xbe from within the dashboard file explorer.

With the modswitch turned off, there is no way you can boot a backup copy of a game. The xbox will detect that the game is not on it's original media, or if you patched the media descriptor in the xbe file, it will refuse to run it because it is not signed properly anymore.

So, maybe the xbox was tsop flashed before the modchip was installed, or you are just selecting another bios on your modchip instead of switching it off, but the way you explain it doesn't make sense.
