So the only working exploit is to install a modchip?
Could you explain in more detail why the different kernel version is a problem?

The kernel version is a problem because the new kernels don't allow you to run Phoenix Bios Loader which allows the Xbox to run a new bios, and hence be able to run backups/homebrew software, etc.  That's why a modchip is pretty much your only solution unless someone comes out with a way to bypass the new kernel blocks and get a bios loader running on them.

If there is one to be found. I think M$ has filled up all the holes in their system with this newest kernel. The problem is not that the bios cannot be replaced cuz then you would still be able to run a dash and sign all xbe files. The problem with this kernel is that it won't allow you to downgrade the dashboard and that is a crucial factor in the exploit scene cuz the exploits only run with old dashes.
I dunno if the hacked gamesaves are blocked though and if you could run habibi signed stuff from there.

There is no way to tell 100 % what kernel version a xbox has on the outside. The newest kernels (5713) seem to show up in mfg dates since november 2003. The kernel version before that (5530) showed up since september 2003 and even though that one allows downgrading of the dash it isn't fully softmodable cuz it won't allow phoenix bios loader to run on it so to mod it you would have to sign all the xbe's within the games/apps in order to run them.
You'd be best of with xboxes from before september 2003 if you can find one.

maybe one could flash the TSOP with a downgraded bios, or is the kernel not what I think it is?

Don't think you can downgrade with a tsop cuz there are rumours around that these new xboxes have new videochips that older kernels won't support. Also if you would tsop you could just as well put a whole new hacked bios on it and not having to exploit it at all.

the bugs are still there but M$ upgraded the fonts and st.db the hacks simply need to be upgraded for it bascily diffrent rev versions confuse the expolites. gamesave hacks still work but pbl doesent work so you need to sighn everything.

When you have a Xbox without a mochip you can't use the devkit? Because your binary won't be signed?
