Tested on Tony Haw Underground
Still doesn't work looks like this game checks the hard bios to the softbios (the one resident in ram) - deduced since it works on hardware modded x-boxes Well it runs just not if you save and reload your save (crashes)

THUG does not check hard bios vs. soft bios, I have run it successfully on a PBL box... It does, however, take a look at your st.db file (with the intention of allowing you to use ripped soundtracks in the game)
A few weeks ago, I was demonstrating the audio hack to a friend using my modded box, and I neglected to remove the hack afterward. At the time Tony Hawk was all I played regularly and it stopped functioning, so I became convinced that my mod had trashed my box, seeing as it wouldn't boot with the mod off and the original disc instead of an HD backup. After a few hours I sorted out the real source of the problem and deleted my st.db file, now it works fine.
If you are attempting to run THUG and you have at one point had an audio hack on your box, try deleting /e/tdata/fffe0000/music/st.db and running THUG again.
This may or may not be the problem in some other games, provided that they are soundtrack aware... during this time I also noted that Tony Hawk 4 would not play, but I didn't deal with any other of my games until I deleted my st.db.
EDIT: Just to clarify, this was the discless st.db file, so I am unclear as to whether this was a result of a cracked ST.DB in general, or because this one contained an invalid soundtrack.
