but...the phoenix is loaded before the Evox...because load the bios from the HD and emulate a modchip...then he starts EvoX...(on an unmodified box)

If I understood correctly, EvoX starts, and if you need to use backups, XBMP or something else you just load the Bios Loader. If you don't you get the error 16.

The solution is simple : Just replace the EvoX file by the Phoenix BIOS Loader, and rename evox xbe in evoxdash.xbe.
