Xbox Modder Sentenced To Five Months
« on: September 16, 2005, 11:53:00 AM »

The owner of console mod retailer Pandora's Cube, Biren Amin, was sentenced to five months of jail time and five months of house arrest, in addition to nearly $250,000 in fines for modding Xboxes and selling them to customers. He was found guilty of conspiracy to commit copyright infringement, and violating that oh-so-enveloping DMCA, whose original sentencing recommendations called for the dunking of people involved in changing or improving upon anything ever created, but was later toned down so it only "prohibits the manufacture and distribution of products or services that circumvent technological protection measures designed to prevent unauthorized access to and copying of copyrighted materials." Three other employees were found guilty and given lesser sentences.

Serves them right.....this store was less than 5 miles from my house.  They were blatantly selling "Superboxes" that had large hard drives and already had several games copied.  Bunch of idiots, if you ask me.  They even had big ass poster advertising these xboxes in the store.

Its not the modding that got them into trouble.  Its the selling xboxes with a bunch of games copied on the HD that did them in.

Old news, it's been on the front page already  Link

The big thing is the sale of the pirated games but selling modded consoles can cause some headaches too...

Now would he have gotten in trouble if he gave the customers a retail copy of all the games on the hard drive?

How did I know that would get your attention.

But User End Agreement, quite simply put it is illegal to modify xbox in any
 shape form or fashion.

B/U games I hear you, but requires modchip.

EULA and law are 2 different things, you violate the EULA and you void your warranty, but its not illegal

by that right lighting and case mods would also be illegal and it would be illegal to change your own oil in your car (and thus illegal for autozone to sell you a case of oil, or damn near anythign they sell)

So then why are mod chips so easy to find?  If they are illegal and the hacked bios and such are illegal why is it so easy to get?
