By modded xbox, I assume you mean something with hacked bios like Evox or Xecuter makes.  Any hacked bios that lets you use an xbox like an xbox will have M$ code in and therefore be illegal to sell.  You may however be able to sell a Linux box.

Ever wonder why none of the chips come pre flashed with any of the illegal bios's such as evolution-x or xecuter?  Hope this helped.
