After speaking with OzXodus.. it's become clear they have chosen to not comment on this situation.. for whatever reason.

So..

Ignore my comments about not using this app. If they won't stand behind their suspicions.. I won't do it for them.

Simple.. the early adopters get nailed.. then eventually post here. (hopefully)

Sometimes.. I find it shocking how fast people will run out and try the latest release. It's great to be first using something.. I suppose. Personally.. watching the dust settle is more my style.. I prefer to not be a guinea pig if I can help it.

Let other get burned first I say.

This is true... I think people forget that contribution sometimes.  Cromwell Bootloader was a huge contribution to the scene.

Did you even read the readme? or just take the 1 line from it?  It is clear that the 'README' gives credit to franz and ed for the "Linux XBE Bootloader", other are parts are credited to mist and others.  My bet is that if you look at the XOS bootloader source, you will see franz and ed in there as well.
