First whats an ACL? Also check your solder connections you probebly have a lose D0 (causing you to boot retail mode).

Lock harddrive, on power up press start then go into utils /tools and lock it will get rid of the harddrive error.

Also you may want to change the xbox bios boot up from eject( use xcontrol on PC ), cause if you press eject to power up and load a cd/dvd it will think you wnat retail box.

As for games scratched/dirty message.......my experience is bad downloads, but you may want to run a  media patcher on the xbe's for the game since on harddrive now.
