Was searching a dashboard update related posts and run in to this one.
I think you should read this post if your dashboard is behaving soewhat strangely.
I had a somewhat similar experience with Ninja Gaiden.
+ dashboard updates.
To start this story from the beginning;
My HW/SW
XboX 1.0 with X-ecuter 1.1 and latest Avalaunch.
So, i updated my dashboard using Pandora Tomorrow DVD.
I ftp'd in to my xbox, changed xboxdash.xbe into the orginal xboxdash.xbe.
I booted up the Pandora Tomorrow and went to the multiplayer and it updated my
dashboard. I booted my machine to the normal Dashboard and now it showed a
live section in it. Exactly what i wanted it to do.
So, i change the updated xboxdash.xbe to the avalaunch again and rename the updated xboxdash.xbe to msxboxdash.xbe (by using evox boot cd + ftp ) and continue to play games couple of days.
(Yeah, xbox was powered off, but the power cord wasn't unplugged)
Then what occurred, was that for some reason when booting the xbox one day, it was fckd up. It tried to boot into some dashboard and it got that fancy service required maintenance screen. I was shocked needless to say.
Well, to test this further, all burned/copied games booted up fine so modchip soldering gone bad wasn't the case. So what could be wrong? The xboxdash.xbe was the Avalaunch latest so how could this be (except it would be buggy)? So i figured that maybe after installing/updating your dashboard, it installs a feature that allows it to boot into another differently named xboxdash.xbe say msxboxdash.xbe.
Well, I inserted evox boot cd and now i installed Evox as a xboxdash.xbe.
Now all worked expect one thing.
When i booted into ms-dashboard from evox (latest evox ofcourse up-to-this-date)
it threw me that fancy service required screen again.
So what i did was that i put the orginal ms-dashboard in to my xbox beside the updated one.
So then i could boot the one that was updated to have the live (which was already in my xbox), and older, default version i had backed up. I had to put some other files into xbox too ( orginal not-updated ms-dashboard files as the update process seems to tamper and do heavy changes to your C imo) to get the orginal un-updated version of the msxboxdash.xbe to boot nicely, like first there were Empty menu when selecting the SETTINGS from the orginal xboxdash.
Ok.
Everything went ok now.
I set the Evolution-x to boot into the orginal un-updated xboxdash.
I then again installed Avalaunch.
All worked fine.
This Saturday night, my friend played Ninja Gaiden that i had put in my HD.
Then my friend powered the machine off, in the middle of the game.
Next thing when i boot is that it takes me to the updated version of the xboxdash.!!
Now i figure this? How? or Why?
Because i had done the exact steps my self a dozen of times and everything worked fine!!
Anyway to be shorter with this post, i fixed it.
To add things UP, as i write this post, my friend just called me of a similar problem.
or should i say the SAME problem.
I installed newest evox to he's machine ( xbox ver unknown to me but mod is SmartXX latest) Everything worked fine UNTIL my friend had pushed the Ninja Tournament in the Ninja Gaiden mainmenu.
According what he said, the machine had booted ( ofcourse it couldn't update dashboard as the dashboard.xbe was evox latest dashboard ) and now it takes him directly to the xboxlive enabled dashboard.

As a conclusion, it should be 100% accurate thing that the update
that comes with ninjagaiden ( dunno how many dash updates there are ) CAN
AND WILL update your orginal xboxdash Even if it's named differently than xboxdash.xbe, now it was named msxboxdash.xbe.
Proof?
Well, the orginal xboxdash WEREN'T LIVE ENABLED, i checked this Personally
when i installed Evox.
Now it IS LIVE ENABLED.
First and last of all, i like to apologize if this issue has been already covered months / years ago.
