If you read what Joe posted... then you would infer the following:
EB2K has been less than honest and fair about this situation. XODUS does the hard work and designs the chip.. EB2K produces and imports it.
EB2K has apparently and intentionally hijacked/stolen the CHAMELEON away from it's creator.. and the creator currently has little recourse.
EB2K, being both manufacturer and importer, have full 100% control of the inventory of CHAMs.. meaning they can pick and choose now who gets to sell it, what it's prices at, and have the ability to sell the chip themselves at a price that is lower (undercut) the prices that resellers who buy chips from them are forced to charge.
It would appear that XODUS has had little luck in securing new manufacturing (but I'm sure they can.. as the design has merit)
It isn't hard to see where this is going.. and that would be the eventual public release of the chip design onto the market.. where a dozen cloners will reproduce chams at an astonishing rate/price, breaking what appears to be an EB2K stranglehold.
It would seem critical for EB2K to retain their relationship with XODUS.. to further advance the design of the CHAM and future chips.. as EB2K had nothing to do with the design of either matrix or cham. Newer motherboard designs are sure to come from MS.. and without XODUS designing the "fixes" eb2k may end up with stockpiles of chips that won't work on newer boards.
I would hope that EB2K will sit down.. and at least hammer out a new deal.. paying the XODUS people what they deserve. It the right, moral, and ethical thing to do.
