Whats Wrong With Posting The Xtender Bios?

They're lying.  It does in fact contain copyrighted code.  They are probably based in a country where MS can't touch them.  It's not hard to find, just look....

That or else they just haven't got sued YET....   I know if I owned a website like this one I would do everything in my power to keep it legit 'cause Micro$oft is one company who's bad side I would not want to be on!

fo sho... I wouldnt want to mess around with MS, but I still have firm belief that the people should have access to knowledge if knowledge is out. Anyone that would want the Xtender or MrSporty release should be able to have it, Xtender released their code for the public, MrSportys release wouldnt be cracked now because Xtender is open source.

Because the mods here take down every link I put up I will not bother posting the link for the BIOS File anymore. I can see xbox-scenes point, they would show a tutorial on making your own "home-brew" chip, but will not let others to help out by giving them the BIOS file, illegal or not, xbox-scene's tutorial used it themselves... Hypocrisy is the word.

It's hard to sue these people, especially because this isn't just software we're talking about - this isn't code that everyone signs an EULA with.  This is some code that's inside the bios.  If a company has a hack for it, so that you can use hardware better, it's your problem.  However, since the bios contains Copyrighted code, it might be illegal.  Most countries though aren't going to care about that.  They care more about the DMCA thwarting this does.  I agree the bios should be freely accessible just like DeCSS, for DVDs.  That it's legal is another story...

also, backup games I have and always will have no problem with doing.  Copying games and playing, I also do not have a problem with.  However, if I like a game, I'll usually buy it.  Same goes for music.

it IS copyrighted code by MS ... that's just where the release comes from.

y do you think xtender doesn't post their own release on their site.

there's a BIG difference between owning something illegal and distributing it ...

And the tutorial doesn't mean I did it myself , i just explain how it should be done.
Maybe I tried it with a flash of my own retail xbox (legal) wink.gif

I understand that MS could not stop them in their own country but places like gamegizmo would not be able to sell it in the states if it contains copyrighted code.

correct , they aren't allowed to sell it ...

I guess we will see a strike back against modchip sellers soon.

yo mr admin, you have a valid point. That is why I stop putting up the URL in the forums, because I respect your forum's rules. I just have a question, If the code is illegal does that mean Xtender is releasing chips with illegal code on them? And it what way does that make it legal?

yes , Xtender is releasing a modchip with copyright protected code on it.
That means the sale of the modchip could easily be stopped.

It's unsure what code enigmah is using , they claim it's not copyright protected.

Even if the code is not copyrighted it's purpose is to defeat the protection schemes that are in place to stop piracy.  Which is illegal in the US under the Digital Millennium Copyright Act put in place by Bill Clinton.  I remember when this bill was signed and I had to start buying my PSX modchips from Canada 'cause all of the US sites that I was using got taken down.  Damn, that sure made it hard on us, lol.
