I have been looking through all of the great skins that are available and I see that a lot of them don't seem to have the standard scrolling menu in the preview does this mean that it is not in the actual file and I would have to use menu editor to put one in?

The simple answer, not that Masamune's is wrong, is that the menu has nothing to do with the skin, but it's put there by Evox. The skin only consists of the main screen, the details(disk space, IP, time, etc...) and the loading screen. The menu is made in evox.ini.
