Update:

Just ended up testing the entire console again, just to make sure all worked well and it seemd the DVD Drive was running somewhat slow, took a little longer than normal to load the game. Not sure if it just seemed that way as i'm used to running games from the hard drive or it has an issue.

So just in case the DVD drive is going I will drop the cost of the system.
