I agree with you. The firmware mod for the 360 hasn't allowed any real cheating going on XBox live like with the first XBox, so for now, why not sell more consoles because their system is selling lots because it's easy to pirate. They have come out with a few new drives to make it harder, and that's probably to make developers happy who are screaming that their games are being pirated and sold on the black market but how hard is it to make a drive with a once only flash or non-writeable flash. They eventually did it with the 1.6 version of the XBox's when they eliminated the TSOP flashability, but right now it's keeping them ahead of Sony. If they wanted they could have put black goop over all the ALT LPC points and stopped modchips all together except for the diehard modder or did a new dashboard update that stopped softmods, but they didn't care at the point. They simply stopped you from playing Live if you were modded so they could keep the integrity of they pay-for-play service. If there is a PS3 loader that comes out that lets people plug in a 750GB drive into their Sony and put all the games they want on it for free, PS3 sale will go through the roof and I bet Sony will be quick to say lots and maybe try and stop, but secretly they want to beat MS, so they'll let it slide for a while.
