Actually, the "impounding and destruction" demands were what made me suspicious as well. That got me thinking as to what this demand would mean - this would probably discourage PS3 sales at the moment right when they are picking up and are slooooowly but surely, getting back on their feet.
If I was suing, then I would ask for royalties or licensing fees rather than have the products impounded or destroyed. As far as I know, that's what most plaintiffs in patent-infringement lawsuits have done, isn't it?
So I wondered, "impounding and destruction" demand would probably create some FUD regarding the PS3 and would certainly discourage sales of the PS3, and possibly Blu-ray discs. In that case, which two companies would benefit most from this lawsuit over Sony? As it happens, one of the two gaming companies is in pretty strong position, and has nothing to fear from the PS3. The other company, on the other hand, has had a strong history of ruthlessness and a certain lack of ethics as far as getting ahead in business is concerned (the browser wars spring to mind).
Not a full-fledged conspiracy theory yet, but I would definitely say that the last demand of "impounding and destruction" does seem to point to an ulterior motive somewhere.
Then again, I could be wrong. Feel free to disagree.
