I would wager it's looking at a version number, I wonder if spoofing the version number in the firmware would trick it.

I think sony should do something along the lines of  
"use this exploit, and create all kinds of awesome software for our system, but the second it is used as a piracy tool, we will know about it, and will fix the hole so no one can use it anymore"

Once the PSP has been fully cracked, I bet the scene releases will have the autoupdate stripped off of them, making it a non problem for those who haven't updated.  

Everyone should buy the games they play, but it's sad that they don't.  They give all of us who are pro-hacking/modifying and actually support the companies bad names.
