My opinion is you should be allowed to sue IF a electronic item causes the fire because of KNOWN malfunctioning parts or issues.

I have seen the sparks myself many times on peoples xbox's.

If the fire happened before m$'s power cord recal then he sure has a case and the insurance company should get money.   Even though the power cord does not stop the issues of the sparking power supply.. it supposedly would stop the issue from getting into the wall socket, so if the fire happens after the recall then the case would be alot harder to win.

After thinkin' about this, makes me wonder what the outcome would have been if the guy would of had a chip-modded xbox. I know it wouldn't be related but could that have allowed MS to build a stronger case against. If so, a few of us on this site would be a bit more aware of when that box is on or off.
