Well, read the laws in your state. Most laws are biased. So even if she's drunk and so are you it's rape!
We had a big lecture about this at our college orientations... Still many techinical "rapes" went unreported, and it's only because she can legally sue your ass and chose not to.

Well Texas is well known for it's "Make my day" laws so I would imagine that they wouldn't go very easy on Rape either.
