Stock Hard Drive And Xbox Live

Hi, I recently had a noobish error and got banned from xbox-live.  I unbanned myself with a new EEPROM, though I have no doubt my gamer tag has been flagged.  In light of this, I have put my stock seagate hard drive back in.

My question is, if I format partition 6 on my seagate to gain those 2 extra gigs, will this get me banned, since my account is flagged?

You could get a new GT that won't be flagged

BTW, did you use the same HDD that was banned with a new EEprom to get unbanned

No, it's an unbanned stock seagate in conjunction with a new EEPROM.  I've complied with the marriage theory.

The question is, if I format my 2 gig F partition, will this ban me?

Getting a new gamertag is not preferable, as I have worked hard for the ranks I currently have, and wish to keep them.

it shouldn't ban you since the M$ bios doesn't load a partition looking for an "F" drive (if I remember right), only your Xecuter/Evox/Indi bios does that. so you should be ok.

Even if the M$ bios does "see" the extra partition, it would be like it sees it on an upgraded hard drive and you don't get banned for that do you?

I'm told that an upgraded HD does indeed get you banned once your name has become flagged.  I'm wondering if a stock seagate with the "F" partition constitutes and "upgraded" HD in MS's eyes.
