I am here to prove this way of unbanning to be 99% working.
The main reason why I say 99%, is because I've only connected to live three times. First after registering a new two month free account, restarting my box and resigning in about a minute later, and about three hours after a meeting and dinner. I haven't been banned yet, I'll update later.
I installed a new 200gig Seagate, without having any prior knowledge of the "marriage" theory, and, because of this, I got banned. I looked around gathering information and ideas on the safest way to get unbanned. I also did not want to return my brand new 200gig HDD because that is too much of a hassle. The steps I took were easy and quick, and got me unbanned in about an hour. I obtained a EEPROM from a friend with an ancient Xbox that has never touched live. This is basic procedure for any type of unbanning. The trick is not with the EEPROM, or having to use a stock or brand new HDD, but with finding the right disk.bin to format with. Having no luck finding one, I went on IRC, in the usual places, and asked if anyone had a Xbox with FTP access that has never been on live, or have live files on it. Sure enough, I met a guy, and he more than gratefully gave me a copy of his. What I did, was extract the Slayer 2.6 xISO, and copied over the new disk.bin, and did a stealth F drive retail Xbox installation. I registered a new account, and I did not get banned.
This proves that no, you do not need to get a new HDD, or revert to buying a new one. "Revirginizing" worked great for me so far, and was a very simple task. No need for a six hour low-level, or any other time consuming task.
