Ok, the marriage theory is correct.

I bought an Xbox, I then played Xbox live while it was still unmodded. I then modded my xbox and installed a new 80gb hard drive, and untill about September I was able to play on Live with the usual method, just play off an original and make sure the chip is off. I then got the message saying Unable to connect to xbox live as your xbox has been modified.

I took my xbox back to my Modchip guy who was able to do it for free as a guinea pig.

He installed a new 80gb HDD and a new Eeprom. So therefore it looks like a new xbox.
For precautionary measures I created a new Live Account incase it was flagged.

I have now been playing on Live for about a month now with no problems at all. So if you have not played Live on your Xbox before it was modded you will not get banned, if you did then you will have gotten banned.

So these are the steps to take:
1. Install new HDD and new Eeprom.
2. Create new Xbox Live Account - Currently free 3 month trials available on Xbox site.
3. Play XBL off original discs and when Chip is switched off.

EVERYTHING WILL WORK. IF NOT EMAIL ME AT [email protected]

Ok, so if I go on Live on an unmodded xbox then mod the xbox at a later date with the same EEPROM and stock HD - will that make a difference? I assume the HD number is the same match with EEPROM as before modding? Thanks for any replies. I am thinking of getting Live and everything but will mod my xbox first just to make sure.

I took the same exact steps and just like you, I've been on for about a month now...still running strong!

That said, I've also made a point of not placing anything homebrew on the C: drive or allow any homebrew apps to save to the E: drive.  For example, after each time I run XBMC I check the saved games via the MS dash and sure as sh** there is a homebrew XBMC save...so I delete it.  Then when only actual game saves are present I log onto XBL.  Have you taken the same precautions or do you have homebrew apps on C: and E: drives?

So, I need to buy a NEW Harddrive?
How bout..instead of buying a new Harddrive- I just swap one from my computer??
Im guessing I just can stick it in Xbox and Slayer will FORMAT it? Or do I need to format it first on the PC and erase my files and all? This should be the same as buying a new HD right?

But..Can I put my Banned 250GB harddrive in a brand new xbox--and will it work on Live??

Yes that will make a difference. To my knowledge you won't be banned as you have not changed the HD. You should be a-OK to go on Live without being banned, but just incase check this with one of the experts first.
