uncapping only works until the modem reaches a state where the modem has to grab a config file again. IE the cbl modem goes offline. (obviosly you can uncap it again but, can be rather trouble some at times)
HSI providers do recieve alarms/alerts for mis-matched config files and can act upon this how they see fit. Not to mention just how unethical this is. I mean you are basically stealing from your neighbors(people on the same node) who are paying for the service just like you are. I mean how would you like to play some XBLive/XBC/XLINK or whatever online gaming you can use and you can't seem to get a decent connection because your neighbor was using all your bandwidth for porn. I would be pissed. It's your choice take the risk and possibly pay for it in the end....IMO it's not worth it, but to each their own.
All the MSO's are doing is covering their ass, by giving the customer a gauranteed service level agreement. If they didn't do that there would be a lot of complaints on service levels/speeds, on the nodes that have these "super seeders" (haha), and download hungry customers. It's all done for regulation and fairness.
