If you have already been flagged then you may be banned in the future. Otherwise, you will most likely not be banned.

If your drive hasn't been flashed (by the MS update) already you will want to update from a legit disk or USB flash drive would be better.

Another alternative is to just flash it yourself although that would require more work.
