I don't think that should be a problem because:
1) jitter can be caused by dying DVD drives or scratched and dirty discs. So M$ can't ban people on these bases alone, that'll end up banning a lot of people with old xboxes.
In a fair & perfect world, you'de be right. But you forget MS doesn't care about it's customers and already ban people for invalid reasons.
Let's take dvd drive replacements. Having a different drive in your console doesn't entail hacking or piracy. Just means the f'in thing broke and was fixed. Even repaired consoles returning from MS official repair centers have mismatched hardware. Yes, that's right, if your console ever broke and was repaired, even if it was repaired by MS themselves, new games won't work and you'll be banned. (IMG:
style_emoticons/default/dry.gif) By all means, feel free to spend hours on the phone with threatning customer service agents trying to explain to them that your illegally modified banned console was modified by MS.
Didn't make any sense when they started that, since all drives were hackable (excluding slims for now as irrevelent since slims didn't exist when this policy was active the first time around), there was no gain to be had by swapping drives. Even now, post AP2.5, it still doesn't make any sense since AP2.5 is a pathetic joke that was hacked right away and accomplished nothing, so it still doesn't matter what drive you have in your console as you can still do what you want regardless. If anything this should be a crime since they KNOW their own legimiate repaired consoles are going to fail & get banned through no fault of the users.
Not to mention you'll get banned for your user name, what city you live in and anything else they decide to ban you for untill you go public and make a stink on national news before they sheepishly apologize for being wrong and unban you.
You must understand that as a consumer, it's your responcibilty to cater to and support them and their whims, not the other way around. This isn't new. This is an attitude MS has held with regards to Windows OS, even before they made VG consoles. Ya know, how MS sets the rules on what hardware you are allowed to use in your computer, and what functionallity you are allowed to perform on your computer, etc.. Full screen dos window, screw you, you don't need to be doing that. Floppy support, screw you, floppys are old, you shouldn't be using them. Embedded logins in urls so you don't need to actually login, screw you, you should be letting windows store all your critical login/passwords for you.
MS is just another arrogant full of themselves company that honestly believes the end goal of the users is to accept what they are willing to provide.
To that end, I absolutly believe they will ban people for jitter and any other anomaly they can detect, regardless if it's valid or not. That they arleady do, there is no reason to expect that to change.
