I've posted a couple times on NH.

For the most part however I was a lurker. Game hacking in general interests me greatly and NH was a great resource.

I'm hoping it turns out well for you.

Mostly just a lurker on NH as well.  I also think that Tecmo is slapping their most hardcore fans in the face, and I am sorry to hear about this mess.  They can take their future product and shove it.  Good luck getting cleared of these bogus charges.

Basicly, they just hit me with 100+ complaints about the website with the intent to shut it down for good as well as take all of the forum records and files so that they can keep tabs on all of the members...

There is little i can really do about this because, although they may not have an entirely solid case against me, the simple matter is that they have more money than i do.  They can spend all they want on attourney fees because they have the money to do so.  As a college student without a solid job, i do not have any money to throw away on attourney fees.

As much as i love the website, there is little i can do to save it apart from spending thousands of dollars defending it.  Unless something miraculous happens in the next week or so, i doubt ninjahacker will be coming back.  I still however will need help with the money to hire an attourny just to attempt to settle out of court...  I don't know if that's going to happen or not, but the result will likely be that i drop the website and they drop the charges aside from their attourney fees.

Anyway, that's the expected forcast for this week...  we'll see if it really plays out like this when i talk to my attourney later on in the week.

Cypher, have you contacted the Electronic Frontier Foundation yet? This is I think, exactly the sort of case they're interested in (in which case you'd be getting some pretty good lawers, and wouldn't actually have to worry about the fees). I think though, it would come down to whether you'd be willing to spend the time and effort that would no doubt be required if the EFF took the case...

Either way, let us know how to donate (paypal, personal check?) and I'm sure there are many ninjahackers (myself included) who will donate as much as we possibly can.

We're all rooting for you! (and I'm very sorry to see you go through this, any way I can help, just say the word)

And I'll be damned if I ever spend a nickel on a Tecmo game ever again.

I don't know much about the Electronic Frontier Foundation, but you can always contact the American Civil Liberties Union (ACLU).  Their website of course is ACLU.ORG and in the lower left hand corner there is button for YOUR LOCAL ACLU.  

Obviously there are numerous examples of what you've done in other types of arenas such as Barbie dolls, ex: Custom Clothes made for Barbie dolls, and you don't see Mattel rounding up all the mothers who may have made costumes without official Mattel authorization.

It's hard to imagine that Tecmo could argue that they are losing money as a result of costumes being made for the games that the people have to buy in order to be able to use the costumes.

well, if the boycot really takes off we wont need to send any list to Tecmo, I think they will catch on when their next games sell a couple (ten? Hundred?) thousand less than expected. Have you though of getting some publicity? maybe show more than just us hackers how Tecmo treats their fans? I dont know a company that likes bad public relations. just a thought

This guy was obviously making money off this.  His only intention was to make a profit from this.  That's why Mattel was able to sue, because they could claim that someone was profiting off their branded product.  In this case, there has been no monetary exchange.

I hate to saw this, but your best defense is probably to try and take this to the press and get as much media coverage as possible. The more bad publicity you can give Tecmo, the more inclined they will be to settle out of court our to drop the charges alltogether. If word of this got out, it wouldnt look really good for Tecmo.

I think the thing to do is to see a lawyer. We've all got kind words to say, but none of us are legal experts (at least no one has admitted as such yet), and none of us can predict what Tecmo will do if Cypher follows any of the advice he's getting from all of us. Publicity of any kind seems like a bad idea until Cypher has spoken to a lawyer.

 Just curious... did ninjahacker ever get a cease and desist letter from Tecmo about the site? I'm suprised they got right down to brass tacks without issuing the customary threats.

It's doubtful that the "press" would take much interest in this, and i am fairly confident that a boycott on our part would have little or no effect on Tecmo's sales...

I am not going to be sour about this.  I am not out for revenge.  All i want is to get out of this without exponentialy multiplying my debts by the time i get out of college.  If at all possible, i intend to start over with a new website that will have strict limitations on file attachments and images.  However if that is not possible, it was a great 2 years, and i will be sad to see it end.
