yeah that means it is "working" but that the graphic is not in the right place or isn't named correctly.
like i said, if you are using the default skin (Project Mayhem III) then the actual directory for that skin should be
Q:\Skin\Project Mayhem III\
the place where XBMC will look for all the graphics for that skin is:
Q:\Skin\Project Mayhem III\media\
so like, if you called a graphic named "splash2ii.png", using this code:

<texture>splash2ii.png</texture>

then it'll be looking for
Q:\Skin\Project Mayhem III\media\splash2ii.png

i don't know how to make it any clearer than that.

well... it didnt work, i changed the resolution several times to the pic and it still cropped from the right side... i'm starting to think that it has someting to do with the reason that is in PAL folder .... i have an NTSC machine so i don't really know how to set NTSC as standard (then change the startup.xml) to the ntsc folder ....

will this work ? or the PAL folder is the default one ?.... can i erase all the PAL folder ? how can i set default the NTSC settings ? (after that can i erase the PAL folders ? )

update:

the skin.xml says default resolution... so i'm gonna go that way to see if it changes ...

update 2:

F**K xbmc fatal error
no suitable skin version found

you special person, you, you somehow managed to screw up the skin. i don't see how you could have even done that when ALL your should be editing is the Startup.xml file. DO NOT edit anything else, it is completely unneccessary.
you should simply try changing the <posx> and <posy> tags for the image. they tell XBMC where the top left corner of the image starts, so basically they control where it gets displayed on the screen. i'm assuming you have already properly calibrated the UI to your TV? if not, please do that before continuing.
